INTRODUCTION 

This manual is compiled in terms of the Promotion of Access to Information Act 2 of 2000 (“the Act”; abbreviated as PAIA). The Act gives effect to the constitutional right of access to information contained in section 32 of the Constitution of the Republic of South Africa, 1996. In terms of the Act, private bodies are required to compile a manual as a guide to requesters of information. This manual further serves to indicate the type of records held by Kipidi Biz College Proprietary Limited trading as Kipidi Biz College and the availability of such records from Kipidi Biz College as a private body.

DESCRIPTION OF THE ACTIVITIES OF KIPIDI BIZ COLLEGE

Kipidi Biz College is focused upon teaching entrepreneurship education to unemployed people in the township environment.

GUIDE ON HOW TO USE PAIA AND HOW TO OBTAIN ACCESS TO THE GUIDE

The Information Regulator has, in terms of the Act, updated and made available the revised Guide  on how to use PAIA (“Guide”), in an easily comprehensible form and manner, as may reasonably be required by a person who wishes to exercise any right contemplated in PAIA and POPIA.

  • The Guide is available in each of the official languages and in braille.
  • The aforesaid Guide contains the description of:
    • the objects of PAIA and POPIA;
    • the postal and street address, phone and fax number and, if available, electronic mail address of:
  • the Information Officer of every public body, and
  • every Deputy Information Officer of every public and private body designated in terms of section 17(1) of PAIA  and section 56 of POPIA ;
  • the manner and form of a request for-
    • access to a record of a public body contemplated in section 11 ; and 
    • access to a record of a private body contemplated in section 50 ;
  • l remedies in law available regarding an act or failure to act in respect of a right or duty conferred or imposed by PAIA and POPIA, including the manner of lodging-the assistance available from the IO of a public body in terms of PAIA and POPIA;
  • the assistance available from the Regulator in terms of PAIA and POPIA;
    • an internal appeal; 
  • a complaint to the Regulator; and 
  • an application with a court against a decision by the information officer of a public body, a decision on internal appeal or a decision by the Regulator or a decision of the head of a private body;
  • the provisions of sections 14 and 51  requiring a public body and private body, respectively, to compile a manual, and how to obtain access to a manual;
  • the provisions of sections 15 and 52 providing for the voluntary disclosure of categories of records by a public body and private body, respectively;
  • the notices issued in terms of sections 22 and 54 regarding fees to be paid in relation to requests for access; and 
  • the regulations made in terms of section 92 .
  • Members of the public can inspect or make copies of the Guide from the offices of the public and private bodies, including the office of the Regulator, during normal working hours.

PROCESSING OF PERSONAL INFORMATION
Purpose of processing personal information

We may use or process any goods or services information, or optional information that you provide to us for the purposes that you indicated when you agreed to provide it to us. Processing includes gathering your personal information, disclosing it, and combining it with other personal information. We generally collect and process your personal information for various purposes, including:

  • Sales purposes – collecting orders or requests for and providing our goods or services; 
  • Marketing purposes – pursuing lawful related marketing activities; and
  • Legal purposes- such as handling claims, complying with regulations, or pursuing good governance.

  • Employees. Personal information that may be processed – name, surname, address, qualifications, gender and race, email address, cell phone number, bank details.

  • Family case history, wealth and related financial information. Personal information may be supplied to business partners and collaborators, consulting psychologists, family therapists, legal professionals, finance professionals

General description of Information Security Measures to be implemented by the responsible party to ensure the confidentiality, integrity and availability of the information

Our hosting company will host our website in a secure server environment that uses a firewall and other advanced security measures to prevent interference or access from outside intruders. We  authorise  access to personal  information only for those employees who require it to fulfil  their  job responsibilities.

DETAILS ON HOW TO MAKE A REQUEST FOR ACCESS TO RECORDS

Requests for access to records of Kipidi Biz College may be made to the Information Officer of Kipidi Biz College.

The requester must apply in writing and pay the required fees as per the Act to the Information Officer. 

On receiving the request, the Information Officer will determine as per the Act, the cost for the preparation of the record for disclosure. If, in the opinion of the Information Officer, it would require more than the hours prescribed for this purpose for requesters, the Information Officer must by written notice require the requester, other than a personal requester, to pay as a deposit the prescribed portion (being not more than one third) of the access fee which would be payable if the request were granted.

The request must be submitted to the head of Kipidi Biz College at his or her electronic mail address in the following manner: 

  • The request must:
    • provide sufficient particulars to enable the Information Officer to identify the record(s) requested and to identify the requester. 
    • indicate which form of access is required, and specify a postal address or an email  address of the requester in the Republic of South Africa. 
    • identify the right that the requester is seeking to exercise or protect, and explain why the requested record is required for the exercise or protection of that right. 
  • If  in  addition  to  a  written  reply,  the  requester  wishes  to  be  informed  of  the decision on the request in any other manner, that manner should be stated as well as the necessary particulars  needed for  the requester  to be  informed  in the other manner. 
  • If the request is made on behalf of another person, proof should be submitted of the capacity in which the requester is making the request, to the reasonable satisfaction of the head of AM. 
PAYMENT OF FEES

A request fee is payable for PAIA requests, and proof of payment of this fee must be sent to the Information Officer together with the request. Once Kipidi Biz College has decided to grant the requested access to information, access fees may be imposed by Kipidi Biz College to the requester subject to the following conditions: 

  • The request fee is aligned to the Regulations published in terms of PAIA for private bodies.   
  • Bank deposit is the only accepted payment method for PAIA requests, using a bank account in the name of AM to be supplied upon receipt of the request. 
  • A request is only deemed to have been received once a written request and proof of payment of the prescribed request fee have been received by the Information Officer.  
  • Upon  receipt  of  the  PAIA  request,  AM  shall  endeavour  to  consider  and provide a response to each request within the prescribed thirty (30) days.  When necessary, AM may extend the period of thirty (30) days for a further period of thirty (30) days in order to finalise the request. 
DECISION

As prescribed by the Act, the Information Officer shall decide whether to grant the requested access to information and inform the requester accordingly. The requester shall be notified of the decision in the most expedient manner possible. 

If the request for access to information is refused by the Information Officer, the requester shall be provided with written reasons for such refusal. 

RIGHT TO CHALLENGE DECISION

If a requester does not agree with the decision, the requester may apply, within 180 days of being advised of the Information Officer’s decision, to the High Court having jurisdiction, for an appropriate order.  

A requester may also seek relief from any court with appropriate jurisdiction in respect of the following decisions of the Information Officer:  

  • the fees required to be paid; and/or  
  • the extension of the period within which the information will be provided.
